Danny Guspie comments to Canadian Press: Retroactive Child Support in Henry and Henry - "According to the ruling the child support orders should provide payor parents with "the benefit of predictability.The ruling is disappointing because it does not appear to make any reference to decreasing child support payments when income declines. It's a very cumbersome system. You have to pay $3,500 for a lawyer if you lose your job to get started on a variation. If you've lost your job, how do you do that?" Danny Guspie interviewed in Canada's National Newspaper - The Globe and Mail : Men need a note from women to receive the new child tax benefit - "The form is offensive and goes against the Charter of Rights, said Mr. Guspie. “I would encourage any man that finds himself in that situation to simply phone up his local tax office and say ‘how would you like to face me in federal court next week?'”.

Alberta Court of Appeal ruling on retroactivity of child support. We have always suggested that fathers be sure to always disclose their income or they may be paying retroactive child support, regardless of any request for proof of annual income. The “Henry and Henry” case in Alberta consolidates this principle, and it will affect every father paying child support in Canada.

The introduction of spousal support guidelines to Canada. While they are being proclaimed as voluntary, you can expect many Courts to refer to them in their judgments making them case law.

Where the arguments fail for "Roe v. Wade for Men" and the Women's Movement This controversial case will force re-examination of abortion rights for women, by asking what rights men have. Abortion is based upon the legal fiction that a fetus is not legally a child, and therefore has no rights. If that is so, then why can't a man opt out before the birth too?

Father wins Custody in Court of Appeal in Parental Alienation Syndrome (PAS) - In this case, the Ontario Court of Appeal upheld a Superior Court of Justice order, transferring custody of the parties children. This was due to the mother's insistentce on doing everything possible to make access impossible. This judgment is great news for divorced dads in Ontario.

FOLLOW THE MONEY...

Good article here on child support enforcement being improved by having a joint custody presumption in Michigan:

Note the following - the industrialization of child support as an adjunct to "The Divorce Industry"

One thousand seven hundred employees now work full-time in Friend of the Court offices as referees, counselors, clerks, and support staff in all 83 Michigan counties. In addition, many employees of the criminal justice system devote a major portion of their workday to this last vestige of debtor's prison.

So it is no surprise that there was consternation in Lansing over a federal plan that cut nearly a quarter billion dollars in Michigan subsidies for child-support enforcement. But one state legislator, Rep. Leslie Mortimer, R-Horton, has introduced a bill that could reduce the need for devoting so many resources to child support enforcement.

The problem we see daily is the "Ghost figures" that Ontario uses for its claim that there is 3 Billion dollars in unpaid child support.

Hogwash - 2 Billion of it is nothing but the meter ticking on matters that never return to Court for a termination order because dad can't afford a lawyer to get his Court order changed. Then he faces licence suspensions and possible jail time.

In the Alberta case Henry and Henry which is currently before the Canada's Supreme Court, a dissenting Judge nailed it perfectly - If child support should automatically go up with an increase of income, fairness dictates the reverse should also happen - Child support should go down when income decreases.

But then what would everybody at Child Support Enforcement do for a real job?

I can only hope this will happen. It cost me over $5000 in legal fees to change my support payments based on my lower income. Some one tell me that this is not right. I am earning less money but I have to pay a ton of money to lower my support payments?
This has got to change!

Hi Bob: The way to make change is to get politically involved. Contact your provincial/state and federal representatives be that here in Canada, or wherever you are located.

Let these politicians know you will support, recruit, vote and actively campaign and contribute financially to any politician’s re-election who will commit to making better laws. See them at their office, phone them and fax them. Make yourself visible, take others with you who agree.
